Petition Filed to Stop Abuse of Turtles at “Snapperfest” Following Undercover Investigation of Cruelty

The national non-profits Animal Legal Defense Fund (ALDF) and Best Friends Animal Society submitted a petition for rulemaking to the Indiana Natural Resources Commission, arguing that the Department of Natural Resources’ (DNR) misinterpretation of state law has allowed for illegal cruelty at Ohio County’s annual “Snapperfest.” Never before seen undercover footage provided by the World Animal Awareness Society – WA2S.org at last summer’s Snapperfest—an event where “contestants” demonstrate their prowess by pulling the heads of live turtles far outside of their shells—reveals numerous acts of cruelty that are in violation of state law. However, the DNR has condoned these actions by stating that Snapperfest participants are exempt from anti-cruelty law under an exception for activities including hunting and trapping, because, so they say, the turtles were trapped prior to their mistreatment at Snapperfest. ALDF and Best Friends Animal Society’s petition asks the Commission to clarify that this exception does not and should not apply to the turtles at Snapperfest—which would render the appalling conduct at the annual event illegal. The petition was filed locally by the Law Offices of Lawrence M. Reuben.

Why are animal advocates and attorneys sticking their necks out for snapping turtles? The undercover video shot at Snapperfest in August 2011 and released today reveals:

  • Turtles held by their tails, which can cause severe damage to their vertebra and internal organs.
  • Turtles repeatedly dropped and thrown to the ground during relays in which contestants run while carrying them.
  • Turtles’ heads pulled out of their shells and turtles held up by their heads during the “main event.” Footage shows contestants violently wrestling on the ground with terrified turtles in an effort to pull their necks out of their shells.

Recklessly, knowingly, or intentionally neglecting a vertebrate animal, as is done during Snapperfest, is a Class A misdemeanor in Indiana.

“While an exception to Indiana’s cruelty statute states that it does not apply to fishing, hunting, or trapping, it does not allow for wanton abuse of any animal after that animal has been trapped,” explains ALDF’s director of litigation Carter Dillard. “The Department of Natural Resources’ misinterpretation of this law has allowed the shameful abuse of turtles at Snapperfest for the past fifteen years—and would literally allow someone to torture a turtle, a deer, a coyote, or any animal to death, so long as that animal had been trapped first. It is time for this legal misinterpretation to be corrected and for the state to put an end to this pathetic event once and for all.”

Rattlesnake Roundup in Georgia Switches to Humane Wildlife Festival

The Center for Biological Diversity, Coastal Plains Institute, Protect All Living Species and One More Generation sent a letter to the Evans County Wildlife Club today praising its recent decision to change its rattlesnake roundup in Claxton, Ga., to a wildlife festival where snakes will be celebrated instead of collected by the hundreds and butchered for their meat and skins. In a separate letter, the groups today also presented a petition with more than 5,000 signatures to the Whigham Community Club asking it to make similar changes to its annual rattlesnake roundup in Whigham, Ga., the state’s last outdated roundup.

“We’re so happy the rattlesnake roundup in Claxton is being switched to a humane event that celebrates these great native animals and recognizes the importance of saving them,” said Collette Adkins Giese, an attorney at the Center for Biological Diversity who works to protect rare and vanishing reptiles and amphibians. “The Whigham Community Club needs to follow suit — it needs to recognize that massacres of endangered animals are just wrong, and clearly the wrong message to send to young people about our relationship to the natural world.”

The Evans County Wildlife Club is replacing its annual rattlesnake roundup with the Claxton Rattlesnake and Wildlife Festival, which will feature displays of the imperiled eastern diamondback rattlesnake and other native wildlife. Educational programs, entertainment and a variety of other activities will be offered at the event, held during the second weekend in March.

“We congratulate the sponsors of the Claxton event for recognizing that all wildlife has a valuable place in nature,” said Dr. Bruce Means, director of the Coastal Plains Institute and an expert on the eastern diamondback rattlesnake. “Now we hope to get the sponsors of the Whigham roundup to see the same light.”

“When the rattlers are collected at the Whigham Rattlesnake Roundup this weekend, we hope that it will be for the last time,” said Olivia and Carter Ries, student founders of One More Generation. “Participants in the Whigham rattlesnake roundup need to recognize the impact they are having on the environment.”

Rattlesnake roundups are depleting populations of eastern diamondback rattlesnakes: Analysis of data from four roundups in the southeastern United States shows a steady decline in the weights of prize-winning eastern diamondbacks and the number collected. This once-common species is being pushed toward extinction not only by hunting pressure but also by habitat loss and road mortality. In August, the Center and allies filed a petition to protect the snake under the Endangered Species Act.

“Georgia is blessed with a rich natural heritage of animals and plants. All of these species — even the rattlesnakes — should be allowed to exist,” said Bill Matturro of Protect All Living Species. “Rattlesnakes serve an important role in the food chain by controlling rodent populations and should be respected.”

Background
The eastern diamondback is the largest rattlesnake in the world. Adults are typically four to five feet long and weigh four to five pounds, but a big snake can reach six feet in length and weigh 12 pounds or more. Scientific studies over the past decade have documented range-wide population declines and significant range contractions for the eastern diamondback.

People fear rattlesnakes, but in reality eastern diamondbacks pose a very small public-safety risk. The snakes are certainly venomous, but more people are killed every year by lightning strikes and bee stings. Those most likely to be bitten are snake handlers who either keep the snakes in captivity or work with them professionally. Still, malicious killings by those who perceive the snakes as a threat are contributing to its decline.

Animal Welfare: Commission urges 13 Member States to implement ban on laying hen cages

News from the European Commission

Today, the European Commission, via a letter of formal notice requesting for information, called on Belgium, Bulgaria, Greece, Spain, France, Italy, Cyprus, Latvia, Hungary, the Netherlands, Poland, Portugal and Romania to take action to address deficiencies in the implementation of EU legislation concerning the welfare of animals, and specifically to implement the ban on “un-enriched” cages for laying hens which applied as of 1st January 2012, as laid down by Directive 1999/74/EC.

The political decision for the ban on “un-enriched” cages was taken in 1999. Member States have had twelve years to ensure a smooth transition to the new system and to implement the Directive. However, so far, and notwithstanding the repeated calls by the Commission, the above mentioned Member States have failed to adequately comply with the EU law.

As from 1 January 2012, Directive 1999/74/EC requires that all laying hens must be kept in “enriched cages” with extra space to nest, scratch and roost, or in alternative systems. According to the Directive, cages can be used only if they provide each hen with at least 750 cm² of cage area, a nest-box, litter, perches and claw-shortening devices, allowing the hens to satisfy their biological and behavioral needs.

Full compliance with the requirements of the Directive by Member States is essential. It is clear that Member States who don’t fulfil their legal obligations not only create consequences on animal welfare but can also cause market distortions and unfair competition. Member States who still allow the use of “un-enriched” cages put businesses that invested in complying with the new measures at a disadvantage.

Thus, following today’s action taken by the Commission, the concerned Member States have two months to respond to the letter of formal notice under EU infringement procedures. If they fail to react satisfactorily the Commission will send a “Reasoned Opinion” requesting concerned Member States to take the necessary measures to comply with the Directive within two months.

Subject: Cape Fur seal cubs in Namibia

I have been contacted by a constituent who has expressed serious concern about the culling of some 85 000 Cape Fur seal cubs each year in Namibia. Given that these seals are already threatened with extinction and there is no evidence to suggest that depleted fish stocks in the region are due to them, she believes this situation must stop. Furthermore, this cull appears to go against Namibian animal protection law, suggesting that the activity is illegal.

My constituent also points out that similar culls in Canada have drawn a huge amount of attention internationally, something that has become a major block to the progress of the EU’s free trade agreement with Canada.

In view of this inconsistency, can the Commission state:

1. whether or not it believes this situation to be acceptable;

2. if not, what steps it is taking to put pressure on the Namibian government to halt this activity as soon as possible?

New EU Strategy fails to highlight benefits of animal welfare for Animals and People

Eurogroup for Animals is extremely disappointed by the EU’s new Animal welfare strategy published today which outlines the future actions proposed to improve the treatment and welfare of animals until 2015.  This strategy lacks any ambition and is a missed opportunity to highlight the role the EU can play in translating citizens concerns into action. Research clearly shows that European citizens care deeply about animals and expect governments to take responsibility and improve animal welfare. This strategy completely ignores this and the positive impact good animal welfare has on animal health, food safety and quality and sustainability.

The Strategy follows an evaluation of 20 years of animal welfare policy which concluded that current rules need to be better enforced and that some animal groups currently outside the scope of EU protection, such as dairy cows and pets, could benefit from harmonised EU laws. The strategy disregards these findings and does not recommend actions to address the concerns raised.

“The animal welfare movement relies on the EU to take its responsibility seriously and to regulate on those areas where animals suffer.  It is astonishing that no future laws are planned and that high profile issues such as live animal transport, the cloning of animals for food and animal testing for cosmetics are not even mentioned in the strategy,” saidSonja Van Tichelen, Director of Eurogroup for Animals.

“We are extremely alarmed that despite there being no evidence that EU animal welfare polices have undermined the competiveness of EU producers the European Commission has listened to the industry and farming lobby and ignored the concerns of Europe’s citizens and the European Parliament as well as the animal welfare sector. The Commission is in effect bringing policy development to a standstill,” she concluded.

All that is left in the Strategy is a focus on enforcement activities and soft policy tools, such as training and communication. The Strategy supports a general framework law which should be established to introduce general principles, but it must also include the use of animal based indicators and the establishment of a European network of reference centres.

Eurogroup is also concerned about the lack of attention to policy coherence and to the use[i] and abuse of animals as a result of other policy decisions. The EU Treaty requires consistency between its policies and Article 13 demands that full consideration needs to be given to animals as sentient beings when drafting legislation in different areas. However, except for agriculture policy and trade, this strategy does not mention the need for coherence with other policies such as research, wildlife protection, consumer protection or sustainable development and this will undoubtedly cause animal suffering.

At 10 pm on January the 15th of 2012, a couple on their way home to Chongqing, southeast of China, found a truck on the highway of Chengdu-Chongqing, filled with over one thousand caged dogs. Thanks to the couple who dialled 110 when they saw this, the police were able to apprehend the drivers of the truck at the next toll station. It was counted later that 1132 dogs were squeezed into miniscule cages being transported thousands of miles to the Guangdong Province, in the south of China, to be slaughtered and eaten at various restaurants.

At 11 pm messages were spreading over the internet through micro blogs such as Chinese Twitter, causing Mr. Chen Ming Cai (陈明才), the founder of the Chongqing Small Animal Protection Association (CQSAPA) and other volunteers to arrive at the scene. The situation was handled well by the police officers who helped volunteers give water to the caged dogs and removed the cages from the truck later as well.

After many long negotiations for more than 20 hours, it was finally at 6 pm on the 16th of January that the dogs were released to the Chong Qing Small Animal Protection Association (CQSAPA). Officers from several local governments with the help of skilled animal rights attorneys, Ms. Cai Chuen Hong(蔡春红律师)and Mr. An Xiang(安翔律师), who communicated over the phone from Beijing, and were able to ensure all dogs were rescued and cared for without having to pay a cent to the dog nappers.

The dog nappers were found to have a Certificate of Quarantine for the truck of dogs, but it was later found that not only did was the certificate for 780 dogs, not over 1100, it was also fake and had a forged signature. The poor dogs were crammed into the truck which had eight levels, which meant over 100 dogs were crowded into one level each. Some dogs were found dead from the severe conditions in the truck, and a female dog was found to have given birth to four puppies during the negotiations. Many thanks goes out to Dr. Li, (重庆圣心动物医疗中心李院长http://weibo.com/vetnet ), a veterinarian from Chongqing, who has been working for over three days and nights to treat injured dogs and take care of the mother and her new born puppies.  Many of the dogs were found wearing clothes because of the cold winter, which were obviously from the dogs’ owners. Many were also wearing collars, indicating that many dogs were kidnapped from their rightful owners. This is a terrible crime and must be stopped in China. The dogs could be heard whining and whimpering, in obvious distress over being crammed into such small places.

Thanks also goes out to the Bureau of Agriculture of the Central Government who have announced 《Six New Regulations for Veterinarians over the whole of the country from January 1st 2012, which seeks to forbid Vets from issuing certificates of animal quarantines out to people》. Hopefully this will stop anymore bad people like this from transporting many dogs to restaurants to be eaten. Many animal advocates have already been contacting the Bureau of Agriculture regarding the new regulations in place, calling for them to detain and prosecute the people who had kidnapped the dogs and forged a fake certificate, as well as make the regulations actual laws which will prohibit people from issuing these certificates.

This is a large step for animal rights in China in 2012, and hopefully things will continue to go this way. It is wonderful to see that everyone’s hard work towards animal rights has not gone to waste. It can be seen that on April the 15th of 2011, 500 dogs were rescued in Beijing where volunteers were forced to pay 115,000 RMB (USD 18,000) in negotiations in order to have the dogs released, and 80,000 RMB (US$12,000) was also paid to get 900 dogs to be released in Zigong on October the 14th of 2011. This is a big difference from now, where the volunteers were able to get over 1000 dogs released to the rescuers without having to pay anything in negotiations.  Rescuers should not be forced to pay money in order to release dogs, in fact, the opposite should be done and dog nappers should be sued for subjecting poor animals to such cruel actions.
It took a lot of time and hard work to remove all the dogs from their cages in the trucks to be transported to larger cages which were donated by loving volunteers. All of the dogs received a medical checkup before being transported in three trucks being replaced. CQSAPA was established in 2005 by Mr. Chen Ming Cai, and since then there have been thousands of dogs rescued before the latest one, while the shelter itself has around 800 dogs that are being cared for by him and his wife with the help of the volunteers. The maintenance of the shelter mostly comes from donations by loving people. Anyone interested in adopting a dog from the shelter can do so by contacting Mr. Chen Ming Cai, phone no: 86 130 3239 9871. We encourage people to adopt dogs from shelters like these instead of buying a dog from a store, as this will help decrease the overpopulation of dogs in China.

Many thanks to all of the volunteers who helped by staying up overnight and working diligently to have all dogs rescued and safe, this could not have gone through without them. We must all view this event as the start to a better life for the animals of China, and continue to rise to the challenge of saving these animals.  We welcome the growing appreciation and awareness for the care of animals increasing all over China.
